1. Subscription and Billing

Hecate is offered as a recurring subscription service. By subscribing, you authorize NEA to charge your selected payment method on a recurring basis according to the plan you choose (monthly or annual).

Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will receive no additional notice before each renewal charge beyond this agreement.

NEA reserves the right to modify subscription pricing. Any pricing changes will be communicated in advance and will apply at your next renewal cycle.

2. Cancellation

You may cancel your subscription at any time. Upon cancellation:

• Your access to Hecate will continue through the end of your current billing period
• No further charges will be applied after the current period ends
• No partial refunds or prorated credits will be issued for unused time within a billing cycle

3. What Hecate Is

Hecate is an AI-powered teaching guide that provides educational feedback on medical expert witness report drafts. It is designed to help clinicians identify areas for improvement in their report writing based on the C.L.E.A.R. Method™ framework.

Hecate is an educational tool. It is not a substitute for independent professional judgment, legal counsel, or peer review.

4. What Hecate Is NOT

Hecate does not provide and should not be interpreted as providing:

• Legal advice or legal review of your report
• Medical advice or clinical guidance
• A professional opinion on the merits of any case
• A certification or guarantee that your report meets any court’s admissibility standard
• A replacement for attorney review of your final work product

You remain solely responsible for the content, accuracy, and professional integrity of every report you submit in any legal proceeding.

5. Document Uploads and Privacy

When you upload a document to Hecate for feedback, your content is processed through a secure AI interface to generate educational feedback.

• Your uploaded documents are not stored permanently by NEA after your session ends
• Your content is not used to train AI models
• Your content is not shared with third parties
• NEA does not retain copies of your reports or case materials

You are responsible for ensuring that any documents you upload do not violate confidentiality obligations, protective orders, or other legal restrictions applicable to you or your cases.

6. AI-Generated Feedback Disclaimer

Hecate’s feedback is generated by artificial intelligence. While the tool is built on a proprietary framework developed from extensive medical-legal experience, AI-generated output may contain errors, omissions, or suggestions that do not apply to your specific case or jurisdiction.

You should always exercise your own professional judgment and consult with retaining counsel before finalizing any expert report.

NEA makes no warranty that Hecate’s feedback is complete, accurate, or appropriate for any particular legal matter.

7. Acceptable Use

Your Hecate subscription is for individual, personal professional use only. You may not:

• Share your login credentials with others
• Allow others to access Hecate using your subscription
• Use Hecate to develop a competing product or service
• Attempt to extract, reverse-engineer, or replicate the system prompt, evaluation criteria, or proprietary methodology powering Hecate

Violation of these terms may result in immediate termination of your subscription without refund.

8. Service Availability

NEA will make reasonable efforts to keep Hecate available and operational. However, NEA does not guarantee uninterrupted access and is not liable for any downtime, service disruptions, or technical issues.

NEA reserves the right to modify, update, or discontinue Hecate at any time. If NEA permanently discontinues Hecate, active subscribers will receive a prorated refund for any unused portion of a prepaid annual subscription.

9. Intellectual Property

Hecate, including its design, system architecture, evaluation criteria, and the C.L.E.A.R. Method™ framework it is built upon, is the intellectual property of National Expert Academy and Tracy Liberatore.

Your subscription grants you a limited, non-transferable license to use the tool for personal educational purposes during your active subscription period.

10. Limitation of Liability

To the fullest extent permitted by law, NEA, Tracy Liberatore, and affiliated entities shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of Hecate, including but not limited to:

• Reliance on AI-generated feedback
• Errors or omissions in Hecate’s output
• Any adverse outcome in a legal proceeding related to a report reviewed by Hecate

Use of Hecate is voluntary and at your own professional discretion and risk.

11. Changes to This Agreement

NEA reserves the right to update this agreement as necessary. The most current version will always be available on the program website. Material changes to subscription terms or pricing will be communicated to active subscribers in advance of the next renewal cycle.
